Any Capitalized terms used but not defined herein shall have the meaning assigned to them under the Terms of Use which govern your use of our website (the “Website”) and our ‘Mista Eats’ application for mobile and handheld devices (the “App”). The Website and the App are jointly referred to as the “Platform, and Pick-up and Delivery Partner is referred as “PDP”.

1.Customer Cancellation

Once subscribe to mistaeats meal plan the cannot be cancel the subscription However, the buyer can choose to pause the prepaid subscriptions like weekly, fortnight and monthly meal plans which he/her has opted.


2.Non-Customer Cancellation

Mista Eats reserves the right to collect a penalty for the Orders constrained to be cancelled by Mista Eats for reasons not attributable to Mista Eats, including but not limited to:

  1. In the event if the address provided by Buyer is either wrong or falls outside the delivery zone;
  2. Failure to contact Buyer by phone or email at the time of delivering the Order booking;
  3. Failure to deliver Buyer Order due to lack of information, direction or authorization from Buyer at the time of delivery; or
  4. Unavailability of all the items ordered by Buyer at the time of booking the Order; or
  5. Unavailability of all the items ordered by Buyer at the time of booking the Order. However, in the unlikely event of an item in an Order being unavailable, Mista Eats will contact the Buyer on the phone number provided to us at the time of placing the Order and inform Buyer of such unavailability. In such an event Buyer will be entitled to cancel the entire Order and shall be entitled to a refund to an amount upto 100% of the Order value.
  6. In case of cancellations for the reasons attributable to Mista Eats or PDP, Mista Eats shall not collect any penalty from the Buyer.


1.Buyer may be entitled to a refund for prepaid Orders.  Mista Eats retains the right to retain the penalty payable by the Buyer in Section I(2) of the Indian Contract Act 1872. from the amount refundable to him/her. The Buyer shall also be entitled to a refund of proportionate value in the event packaging of an item in an Order or the complete Order, is either tampered or damaged and the Buyer refuses to accept at the time of delivery for the said reason.

2.Buyer may be entitled to a refund upto 100% of the Order value if PDP fails to deliver the Order due to a cause attributable to either PDP or Mista Eats, visit however such refunds will be assessed on a case-to-case basis by Mista Eats.

  1. Any complaint, with respect to the order which shall include instances but not be limited to food spillage, foreign objects in food, delivery of the wrong order or food and beverages or Products, poor quality, you will be required to share the proof of the same before any resolution can be provided.
  2. You shall not be entitled to a refund in case instructions placed along with the order are not followed in the form and manner You had intended. Instructions are followed by the Restaurant Partner /Store on a best-efforts basis.

5.All refunds shall be processed in the same manner as they are received, unless refunds have been provided to You in the form of credits, refund amount will reflect in your bank account based on respective banks policies.

4.PDP Cancellation Fee

1.Cancellation of a Pick-up and Drop order after the delivery partner has reached the location but has not picked up the items may invite a cancellation fee in the range of Rs. 30 to Rs. 50.

2.Cancellation of a Pick-up and Drop order after the delivery executive has picked up the delivery items will result in a cancellation fee being charged equivalent to the entire service fee.
